General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers via the online shop "midnightplant."

A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.


2. Contractual Partner and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By clicking the "Buy Now" button, you submit a binding offer to purchase the goods in your shopping cart.

The purchase agreement is concluded only upon acceptance of the order or dispatch of the goods.


3. Prices and Shipping Costs

All stated prices are final prices. Due to the application of the small business regulation according to § 19 UStG, no sales tax is shown.

Additional shipping costs incurred will be indicated separately during the order process.


4. Payment Terms

Payment is made via the payment methods offered in the online shop.

The payment method will be charged according to the terms of the respective payment service provider.


5. Delivery

Delivery will be made to the delivery address provided by the customer.

Should an ordered item not be available, the customer will be informed immediately.


6. Retention of Title

The goods remain the property of midnightplant until full payment has been received.


7. Right of Withdrawal

Consumers have a statutory right of withdrawal. Details can be found in the separate withdrawal policy.


8. Warranty

The statutory liability for defects applies.


9. Liability

The provider is liable without limitation for damages resulting from injury to life, body, or health, as well as for intent and gross negligence.

Otherwise, liability is governed by statutory provisions.


10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR platform):

There is no obligation and no willingness to participate in a dispute resolution procedure before a consumer arbitration board.


11. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory statutory consumer protection regulations conflict with this.
